1. Who you are agreeing with
The site and the Blueprint are operated by Bentley Strategy, LLC, a Texas limited liability company located in Frisco, Texas ("Bentley Strategy," "we," "us," or "our"). "You" means the individual using the site, and, if you are using it in the course of your employment, the organization on whose behalf you act. If you accept these terms on behalf of an organization, you represent that you have authority to bind that organization.
2. What the Blueprint is, and what it is not
The Future-Ready Martech Blueprint is a self-assessment tool. It takes the answers you and your colleagues provide, applies our capability model and scoring methodology, and returns a capability diagnostic, an alignment view, and a ranked set of suggested investment priorities.
Its output is a structured reflection of the inputs you supply. It is provided for general informational and planning purposes only.
The output is not professional advice. It is not consulting, legal, financial, accounting, investment, or technical advice, and it does not create a consulting or advisory relationship between you and Bentley Strategy. It is not a substitute for the judgment of qualified professionals who know your specific circumstances. Decisions about technology purchases, budgets, vendors, staffing, or strategy remain yours alone, and you are solely responsible for them and for their consequences.
The accuracy and usefulness of any result depends entirely on the accuracy, completeness, and honesty of the inputs provided. We do not verify your inputs and we do not warrant any result.
3. Your license to use it
Subject to these terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access the site and to use the Blueprint for your own internal business purposes, and to generate, download, print, and share your own resulting report within your organization and with your professional advisors.
All rights not expressly granted are reserved.
4. What you may not do
You agree that you will not, and will not permit anyone else to:
- Sell, resell, license, sublicense, rent, lease, distribute, or otherwise commercially exploit the site, the Blueprint, or any part of them;
- Use the Blueprint, its capability model, its questions, its scoring methodology, or its outputs to build, train, market, or operate a competing or substantially similar product, service, assessment, or offering;
- Deliver the Blueprint, or a derivative of it, as part of a paid engagement for a third party without our prior written permission;
- Copy, modify, adapt, translate, or create derivative works from the site or the Blueprint, except for your own report as permitted above;
- Reverse engineer, decompile, disassemble, or attempt to derive the underlying methodology, weightings, dependency logic, or algorithms, except to the extent this restriction is prohibited by applicable law;
- Scrape, crawl, harvest, or use any automated means to access, extract, or index the site or the Blueprint, or use any part of it as input to train a machine learning or artificial intelligence model;
- Remove, obscure, or alter any copyright, trademark, confidentiality, or other proprietary notice;
- Circumvent or attempt to circumvent any access control, access code, rate limit, or security measure;
- Interfere with or disrupt the site, or attempt to gain unauthorized access to any system or data;
- Use the site or the Blueprint in violation of any applicable law or regulation, or to submit content you do not have the right to submit.
5. Our intellectual property
The site and the Blueprint, and all content and materials in them, are owned by Bentley Strategy, LLC or its licensors and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.
Without limiting that, the following are proprietary to Bentley Strategy and are expressly not licensed to you except as set out in section 3:
- The capability model, including the capability areas, the individual capabilities, their plain-business naming, and their selection and arrangement;
- The set of business outcomes, the outcome-to-capability dependency map, and the primary and supporting dependency weightings;
- The scoring methodology, including all coefficients, thresholds, multipliers, inheritance rules, and the alignment and contradiction detection logic;
- The roadmap prioritization logic and the reasoning shown with each recommendation;
- The questionnaire, the pain-point set, and the wording of all questions and results copy;
- The visual design, layout, blueprint treatment, report and print templates, and all graphics; and
- The software, source code, and object code of the site and the Blueprint.
"Bentley Strategy," the Bentley Strategy logo, and "The Future-Ready Martech Blueprint" are trademarks of Bentley Strategy, LLC. You may not use them without our prior written permission, except to refer accurately to us or to the Blueprint.
6. Your answers, your report, and your data
Your inputs remain yours
As between you and Bentley Strategy, you retain all rights in the answers, organization details, tool selections, and free-text comments you submit ("Your Inputs"), and in the report generated from them. We claim no ownership of Your Inputs.
Where your answers live
In the current version of the Blueprint, your assessment answers are processed in your own browser and saved only in your own browser's local storage on your own device. They are not transmitted to us and we cannot see them, unless you separately choose to send them to us, for example by emailing us an exported file or by submitting the feedback or access-request forms. Clearing your browser data will erase them, and we cannot recover them for you.
License to us
You grant Bentley Strategy a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, host, store, reproduce, and process Your Inputs solely to (a) provide and support the Blueprint to you, and (b) create and use de-identified and aggregated data, statistics, benchmarks, and insights.
De-identified and aggregated data is data from which all identifiers of you, your organization, and any individual have been removed, and which cannot reasonably be used to identify you or your organization. We may use and publish such data for any lawful purpose, including improving the Blueprint and producing industry benchmarks. We will not publish de-identified data in a form that identifies you or your organization, and we will not publish your organization's individual results without your written permission.
7. Feedback
If you send us suggestions, ideas, feature requests, or other feedback about the site or the Blueprint, you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use and incorporate it without any obligation, attribution, or compensation to you. Please do not send us anything you consider confidential or that you are not free to share.
8. Preview and access codes
Parts of the Blueprint may be made available in preview form or behind an access code. Preview features may be incomplete, may change, and may be withdrawn at any time. Access codes are provided for your use only and may not be shared, published, or transferred. We may revoke any access code at any time.
9. Third-party names and references
The Blueprint refers to third-party software products and vendors by name so that you can identify your own technology stack. Those names and marks belong to their respective owners and are used descriptively only. Their inclusion is not an endorsement, a recommendation, a certification, or any statement about their quality, and it does not indicate any affiliation, sponsorship, or partnership between those companies and Bentley Strategy.
The Blueprint's architectural direction builds on publicly available third-party research, which is credited where it appears. That credit indicates the source of an idea. It does not imply that the cited authors or publishers reviewed, approved, endorsed, or are associated with the Blueprint.
10. Disclaimer of warranties
THE SITE, THE BLUEPRINT, AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENTLEY STRATEGY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SITE OR THE BLUEPRINT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY SCORE, DIAGNOSIS, PRIORITIZATION, RECOMMENDATION, OR OTHER OUTPUT WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR YOUR PURPOSES, OR THAT ACTING ON ANY OUTPUT WILL PRODUCE ANY PARTICULAR RESULT.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENTLEY STRATEGY AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR ANTICIPATED SAVINGS, OR FOR ANY COST OF SUBSTITUTE PRODUCTS OR SERVICES, ARISING OUT OF OR RELATING TO THE SITE, THE BLUEPRINT, OR ANY OUTPUT, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, THE BLUEPRINT, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US FOR THE BLUEPRINT IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
YOU ACKNOWLEDGE THAT ANY DECISION YOU MAKE IN RELIANCE ON THE BLUEPRINT OR ITS OUTPUT, INCLUDING ANY TECHNOLOGY PURCHASE, BUDGET, VENDOR, STAFFING, OR STRATEGIC DECISION, IS MADE AT YOUR OWN RISK AND ON YOUR OWN JUDGMENT.
These limits apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless Bentley Strategy, LLC and its members, officers, employees, contractors, and agents from any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the site or the Blueprint, Your Inputs, your violation of these terms, or your violation of any law or the rights of any third party.
13. Changes and termination
We may modify these terms at any time. If we make material changes, we will update the "Last updated" date above and, where practical, provide additional notice. Your continued use after a change takes effect means you accept the revised terms.
We may change, suspend, limit, or discontinue the site or the Blueprint, in whole or in part, at any time and without notice or liability. We may suspend or terminate your access at any time, including for any breach of these terms. Sections 5, 6, 7, and 9 through 15 survive termination.
14. Governing law and disputes
These terms and any dispute arising out of or relating to them, the site, or the Blueprint are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and Bentley Strategy agree to the exclusive jurisdiction and venue of the state and federal courts located in Collin County, Texas, and each party waives any objection to that venue.
Any claim must be brought within one year after it arises, or it is permanently barred, to the extent permitted by law.
15. General terms
These terms, together with the Privacy Policy, are the entire agreement between you and Bentley Strategy regarding the site and the Blueprint, and supersede any prior understandings on that subject. If any provision is held unenforceable, it will be modified to the minimum extent necessary and the rest will remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries. Headings are for convenience only.
